Terms of Use Agreement & Consent Agreement for Electronic Disclosures and Communications from MSY!com (MSY!)

Please read this information carefully and print a copy and/or retain this information for future reference.

1. TERMS OF USE AGREEMENT FOR ALL SERVICES AND THE WEBSITES

Mike Says Yes!com (MSY!) requires that you carefully read, understand and agree to the following Terms and Conditions contained in this Terms of Use Agreement ("Agreement"). By accessing, browsing or using this website, and the websites of the below listed companies, divisions or service groups, or any page thereof, through any direct or indirect means (individually or collectively, "Websites" or "Website"), or by using the goods, facilities or services offered in or through the Websites through alternative methods (including, for example, telephone, mail, text, email or facsimile), you accept and agree to be bound by these Terms of Use (the terms "Website" and "Websites" include use through these alternative methods).

THIS AGREEMENT CONTAINS AN AGREEMENT TO ARBITRATE ALL CLAIMS AND CONTAINS DISCLAIMERS OF WARRANTIES AND LIABILITY (please see sections 8 and 15). These provisions form an essential basis of our bargain.

If you do not agree to these terms and conditions, you are not authorized to access or use the Websites and you are to cease accessing or otherwise using the Websites.

For purposes of this Agreement, "You" or "Your" means the person(s) using the Websites, and/or the goods, facilities or services of MSY!com (“Site” and/or “Services”) and its companies offered through alternative methods, including persons that allow others to provide information about themselves to MSY!com (as defined below),

· Aarons, Inc.

and their divisions /service groups (including, but not limited to, Aarons, Inc. franchisee or franchisee partners.

THE DISCLOSURES AND CONSENT REQUIRED UNDER CERTAIN STATE LAWS ARE DEEMED TO BE PROVIDED, RECEIVED AND AGREED TO BY USE OF THE WEBSITES.

MSY!com (hereinafter “MSY!”) operates the Websites and shall have the right at any time to change or discontinue any aspect or feature of the Websites and the right to modify the terms and conditions applicable to users of the Websites, including these Terms of Use, or any part hereof. Such changes, modification, additions or deletions shall be effective immediately upon posting on the Websites. Any use by you of the Websites or the good, facilities or services offered in or through the Websites shall be deemed to constitute acceptance of such changes. By accessing this Site you agree to be bound by these Terms of Use. The Site is intended for individuals who are at least 18 years of age and reside in the United State and the District of Columbia. If you are under 18 years of age or reside outside of the United States or the District of Columbia, you should not be visiting this Site or utilizing MSY!com’s Services.

2. RENT/LEASE TO OWN REQUEST SERVICES

MSY! offers two Rent/Lease To Own request services via one hybrid form, each of which is explained in more detail below.

The first service option occurs when you complete a traditional “quick contact” AKA “Unlock My Local Deals” (after agreeing to the full Electronic Consent and these Terms of Use and the above Privacy Policy) you agree to get matched with Fulfillment Partners who may respond with Rent/Own Lease offers through return contact via email or phone. Because these matches are generated from a subset of information from the contact request, the Fulfillment Partners network will not be able to respond with customized offers and pricing until they speak with you to get additional information.

The second service option occurs when you complete a product information form commonly referred to as “short form” wherein you provide your basic contact and location information after agreeing to the full Electronic Consent and these Terms of Use and the above Privacy Policy), which you may either (i) select prior to completing the short-form loan request or (ii) directly select. If you select the “short form” we will match you with Fulfillment Partners on the MSY! network using a subset of the information contained on the form request. Because these matches are generated from a subset of information from the form request, the Fulfillment Partners network will not be able to respond with customized offers and pricing until they speak with you to get additional information.

The third service option occurs when you complete a general inquiry form commonly referred to as “contact form” wherein you provide your basic contact and location information. If you select the “contact form” we will match you with Fulfillment Partners on the MSY! network using a subset of the information contained on the form request. Information through this contact form, may be exchanged electronically and their may be no need to speak with you to get additional information.

The fourth service option occurs when you complete a form commonly referred to as “deal form” wherein you do provide your basic contact and location information. If you select the “deal form” you agree to be sent MSY! deals on Lease/Rent to Own Products and Categories in your service area. 

3. Consent Agreement for Electronic Disclosures and Communications from MSY!com (MSY!)

Introduction. You are submitting a request to be matched with Mike Says Yes!com (MSY!) fulfillment partners. MSY! will send your information to our pre-selected “brick and mortar” fulfillment partners, who will contact you and provide more information about the category, product or general questions. Ultimately, our fulfillment partners will engage you to contract, deliver and service your rent/lease agreement. MSY! services are free to the consumer and are wholly completed online. Please see the "Terms of Use Agreement, incorporated herein by reference, for additional information, definitions and terms. MSY! can only provide you the benefits of its services by conducting its business electronically. In order to do this, we need your consent to provide you with certain disclosures, notices and other communications (“Disclosures and Communications”) in connection with your category, product or general rent/lease to own inquiry ("Lease Inquiry").

Scope of Consent. Your consent to receive Disclosures and Communications and to do business electronically, and our agreement to do so, applies to this Rent/Lease to own Category, Product or General Inquiry with MSY! and its participating Network of Fulfillment Partners.

Withdrawing Consent. Because MSY! will provide the Disclosures and Communications to you instantaneously, you will not be able to withdraw your consent to do business electronically with MSY! or  during the Initial Lease/Rent Inquiry process. However, after your Inquiry is submitted, you may withdraw your consent to do business electronically in connection with your Inquiry with MSY! or its Fulfillment Partners at no cost to you. If you choose to withdraw your consent in connection with your Loan Inquiry, you can receive future Disclosures and Communications in paper form, by U.S. mail at no charge to you.
